These Terms and Conditions (hereinafter, the “T&C”) govern the access, browsing, and use of the website https://mios.academy/ (hereinafter, the “Website”), as well as the subscription to the various content access plans and educational services offered through the online platform (hereinafter, the “Platform”) managed by MIOS ACADEMY, S.L. (hereinafter, “MIOS ACADEMY” or “we”), a company registered at Ronda General Mitre 126, 6, Barcelona, 08021, Spain and registered in the Commercial Registry of Barcelona, in Volume 1000443583575, Folio 1, Section 1, Page B-629994, with Tax Identification Number (NIF) B75869891.

 

By purchasing any of the available plans, the user declares that they have read, understood, and accepted these T&C, as well as the Website’s Privacy Policy and Cookie Policy. Acceptance of these terms is essential to complete the purchase and gain access to the content available on the Platform.

 

If you do not agree with these T&C, you must refrain from using this Website and from subscribing to any of the offered plans.

 

1. Purpose

 

These T&C govern the terms and conditions applicable to the subscription plans contracted by the interested party, through which access to the Platform is provided. MIOS Academy is the online hub for cuting-edge orthognathic surgery focused on enabling you to learn the latest techniques – from the first photo to the final suture – designed to improve patient outcomes.

MIOS Academy features world-renowned experts who share their knowledge, innovations, and insights into the future of minimally invasive orthognathic surgery.

It offers highly valuable knowledge and practical lessons to keep your skills and expertise at the forefront.

With our segmented monthly subscription plans, you can access the MIOS Academy content that best matches your preferences and interests.

Depending on the selected plan, users may enjoy various benefits, including access to courses, educational materials, events, and the delivery of relevant content.

 

2. Purchase process

 

The subscription process will be carried out by the interested party as follows:

 

• Select the desired plan from the pricing page.
• Complete the purchase form with their personal information.
• Explicitly accept these Terms and Conditions and the Privacy Policy.
• Make the payment through the available methods.
• Receive a confirmation email with the order summary and access to the platform.

 

3. Pricing, payment, and billing

 

All prices listed on the Website are expressed in euros (€) and include applicable taxes.

By completing the purchase process, you agree to pay the indicated price and authorize us to charge the amount to your debit or credit card, or to process it using any of the payment methods available on our Website.

MIOS ACADEMY partners with payment service providers to offer convenient payment methods and to keep your payment information secure.

Once the payment has been completed, an electronic invoice will be issued and sent to the email address provided by the user.

 

4. Refunds and right of withdrawal

 

In accordance with Article 102 of Real Decreto Legislativo 1/2007, de 16 de noviembre, which approves the Texto Refundido de la Ley General para la Defensa de los Consumidores y Usuarios (hereinafter, “TRLGDCU”), you may exercise your right of withdrawal within fourteen (14) calendar days from the date of purchase.

The exercise of the right of withdrawal does not require any specific formality; it is sufficient that you notify us of your decision to withdraw within the aforementioned period by sending an email to info@mios.academy indicating your name, full address, and, if available, your telephone number and email address. In any case, you may use the model form included in Annex I of the TRLGDCU, accessible HERE.

Once the above has been processed, we will proceed to reimburse the amounts paid.

Notwithstanding the above, if you have accessed the platform for the first time or consumed any educational content, the right of withdrawal shall not apply, in accordance with Article 103(m) of the TRLGDCU.

 

5. Promotional codes

 

We may offer promotional or discount codes or special offers, which will be indicated in each case along with the web form used to process the purchase of the selected plan. Unless otherwise stated, promotional or discount codes and special offers may not be combined.

 

6. Intellectual and industrial property

 

The interested party agrees to use the content and services made available on our website, including but not limited to texts, graphics, images, icons, technology, software, links, and other digital, audiovisual, or sound content, as well as its graphic design and source code,  in accordance with the law, these Terms and Conditions, and other notices, usage regulations, and instructions provided, as well as with generally accepted moral standards and public order. In particular, you agree to refrain from:

Reproducing, copying, distributing, making available or otherwise publicly communicating, transforming, or modifying the services and content, unless you have the authorization of the rights holder or such actions are legally permitted.

Removing, manipulating, or in any way altering the copyright notice or other identifying data of MIOS ACADEMY or any third-party rights holders.

Exercising or abusing the exploitation rights associated with such content unless you have been expressly authorized to do so by the legitimate owner and, where applicable, under the expressly agreed conditions.

Using data extraction methods (“scraping”), spiders, robots, or any other type of automated tools or means.

 

In short, the content and other services are protected by the intellectual or industrial property rights of MIOS ACADEMY or third parties. No rights over them shall be understood to be transferred under these conditions or by virtue of the services, beyond what is strictly necessary for the proper use or access to the website and the services and content (non-sublicensable to third parties due to the nature of the service and associated legal requirements) that are or may be provided through it.

 

7. Data privacy

 

The personal information or data you provide will be processed in accordance with the provisions of our Privacy Policy. By proceeding with registration and enrollment through the web registration form provided, you authorize us to process your personal data based on your consent, as well as for the performance of the contract described in these T&C.

You acknowledge and declare that all information or data you provide is true and corresponds to reality.

 

8. Disclaimer of liability

 

Except in those cases where otherwise legally required, MIOS ACADEMY shall not be held liable for any misuse, unlawful use, or unauthorized use of the Website or the Platform and the services offered through it, particularly when such use is conducted in violation of these T&C or disregards the instructions provided by MIOS ACADEMY.

In particular, MIOS ACADEMY shall not be liable for:

 

• Any damages or losses resulting from the incorrect, inappropriate, or unlawful use of the platform by users.

 

• Any content, information, or data entered by users in their profiles or communications through the platform, provided that MIOS ACADEMY has no actual knowledge of its unlawful nature.

 

• Any damages, losses, or claims arising from direct interactions between users, including, but not limited to, contacts made outside the platform via messaging apps, social media, phone calls, or in-person meetings.

 

Notwithstanding the foregoing, MIOS ACADEMY undertakes to adopt reasonable technical and organizational measures to ensure the security of the personal data processed, as well as to detect and mitigate any potential misuse of the Website.

MIOS ACADEMY reserves the right to remove any content or suspend user access in cases of inappropriate use or use that is contrary to applicable law in relation to the services provided through the platform.

 

9. Modification of the T&C

 

MIOS ACADEMY reserves the right to modify these T&C at any time. The new conditions shall apply from the moment they are published on the Website; therefore, periodic review is recommended.

 

10. Applicable law

 

These T&C are governed by Spanish law, including but not limited to the Real Decreto Legislativo 1/2007, de 16 de noviembre, which approves the Texto Refundido de la Ley General para la Defensa de los Consumidores y Usuarios (“TRLGDCU”); Ley 7/1998, de 13 de abril, sobre Condiciones Generales de la Contratación; the LSSICE; the EU General Data Protection Regulation (Regulation (EU) 2016/679) of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, which repeals Directive 95/46/EC (“GDPR”); and the Ley Orgánica 3/2018, de 5 de diciembre, de Protección de Datos Personales y Garantía de los Derechos Digitales (“LOPDGDD”).

 

11. Dispute resolution

 

Any dispute relating to these T&C shall be submitted to the Courts and Tribunals of the City of Barcelona, unless the applicable regulations establish the jurisdiction of other Courts and Tribunals for this purpose. If the interested party qualifies as a consumer, the applicable jurisdiction shall be that of their place of residence.
